MEL VATZ: Worker's compensation sounds like a simple idea. If you've been injured while in the course of your employment, then you are entitled to worker's compensation benefits. If you need medical treatment, you are entitled to medical expenses. If you are unable to work because of this work injury, then you are entitled to wage loss payments. People unfortunately don't always get treated the way they're supposed to get treated by the employer, by the insurance company.

What is different about worker's compensation from other cases, such as auto accidents is that if you're injured at work and they have worker's compensation coverage, you can't sue your employer. You can't sue them for negligence. But you don't have to prove that anybody did anything wrong. So simply, if you're injured why you are working, then you are entitled to worker's compensation benefits.

If you get a call from a worker's compensation insurance adjuster about settling your case or if you have any questions about whether it's an appropriate time to think about settling your case, please call us for advice. There is no charge to meet with us. We're here to help.
